PRIVACY STATEMENT

Introduction

This is the privacy statement of USG People N.V., USG People The Netherlands B.V. and the Dutch operating companies forming part of the USG People N.V. group, which are involved in services in the field of employment and employment mediation. This concerns (inter alia) the labels Start People, Unique, Secretary Plus, USG Professionals, Creyf’s, ASA, Technicum, CapitalP, USG Freelance and Receptel, whereby a label may consist of several operating companies (for example Start People and Start People Inhouse Services).

USG People N.V. and USG People The Netherlands B.V. are responsible for processing your personal data as are the Dutch operating company/companies of the USG People group. USG People N.V., USG People The Netherlands B.V. and the Dutch operating company/companies of the USG People group have, inter alia, their registered offices at P.J.Oudweg 61 (1314 CK) Almere, the Netherlands.

If you, as an agency worker, candidate, applicant, self-employed worker without employees or (direct or hired) employee, provide personal data to a Dutch operating company of USG People N.V., your personal data will be included in the database of USG People N.V., USG People The Netherlands B.V. and the Dutch operating companies of the USG People group. This also applies to the data we receive from you as an employee or representative of a (potential) business relation (such as a (potential) client, supplier, seller or another company or organisation.

Where reference is made in this privacy statement to USG People, such will be a reference to USG People N.V., USG People The Netherlands B.V. and the Dutch operating company/companies of the USG People group.

Your privacy is of great importance to us. The personal data you have provided to us are handled carefully and protected in accordance with the Personal Data Protection Act. Where necessary, USG People has notified the processing of personal data to the Dutch Data Protection Authority (DPA). These notifications can be consulted in the DPA notifications register that can found on the DPA website: http://www.cbpweb.nl.

Website visitors data that we process

In general, you can visit our website without providing us with personal data. Similarly to many other websites, we do collect certain non-identifying automatic data concerning the users of our websites. We also process data concerning the date and time you visit our website(s) and page(s), the region from which you visit our website(s), the website(s) that directed you to our website(s), the pages and sections of the website(s) you visit (how long and how often and in what order), the information you consult and the information you upload or download from the website(s).

The collected data are used to align the content of the website as much as possible with the wishes and requirements of the visitors of our website(s). We may forward the non-identifying information to third parties and these data are stored for future use. We refer to the cookie statement on our website(s) for more information about the cookies we use.

Our websites may include references and/or hyperlinks to one or more third-party website. This privacy statement does not apply to those websites and we recommend that you review the privacy policy of these third-party websites, so that you will be aware of the manner in which they handle privacy.


Data we process concerning agency workers, candidates, applicants, self-employed workers without employees or (direct or hired) employees

We use the personal data received by USG People from its agency workers, candidates, applicants, self-employed workers without employees or (direct or hired) employees for the following purposes:

  1. in order to comply with applicable legislation and regulations;
  2. to establish and maintain an employer/employee relationship or a personnel/employment mediation relationship with you and conduct a personnel, financial, time recording, absenteeism and/or salary administration for this purpose, or to establish and maintain a relationship aimed at acquiring/performing assignments and conduct a financial administration for this purpose;
  3. in order to assess your suitability for a certain position or assignment, to record your availability and to bring you into contact with or introduce you to one or more (potential) clients and/or relations;
  4. to provide employment mediation services to you, to offer you training or training opportunities, career advice and/or other (work-related) services, to assign you to clients, have you perform activities for clients, or to arrange assignments for you;
  5. to conclude agreements with you, our client(s) and/or relations and to be able to perform and comply with these;
  6. to assess whether you qualify for a (premium) discount and/or subsidy or whether you come under a (premium) discount or subsidy scheme;
  7. to comply with our reintegration obligations and to comply with the aim imposed by the government of helping people with a great(er) distance to the labour market to find work;
  8. to promote and encourage your personal development, to enable you to take part in (online) tests and to be able to generate test results;
  9. to inform you about our services, other activities and/or job-related information (for example via e-mail, newsletters, company magazines and professional literature) and to be able to make you offers on behalf of USG People;
  10. for management purposes and for generating management information and reports, conducting market surveys, (internal and external) checks and audits and for promoting and maintaining company safety;
  11. to be able to grant you access to and make use of our closed web and personal environments, (self-service) portals and our intranet;
  12. to inform you of the products and/or services of our carefully selected partners by placing information in this regard on our websites or by including information in this connection in our newsletters, company magazines and the like.

USG People processes inter alia the following data: Name and address details, e-mail address, telephone number, contact details, nationality, date and place of birth, gender, marital status, curriculum vitae (CV), work experience, bank account number, policy or client number health insurer, training and education details, (copy of) certificates, references, (copy of) passport photo, (copy of) ID, Citizen Service Number, (copy of) work permit, (copy of) residence permit and (copy of) Declaration of Independent Contractor Status. If you have been provided with a username and password to obtain access to our closed web and personal environments, (self-service) portals and/or our intranet, these data are also processed by us.

USG People may pass your personal data on to its (potential) clients and relations, suppliers (for example training institutes), audit agencies, government agencies, subcontractors and to companies and/or persons it has engaged to perform certain activities (including processors). USG People may also pass your data on to third parties if it has the right or obligation to do so on the basis of applicable legislation and/or regulations, court order or judgment, or if you have consented thereto. After it has obtained your consent, USG People may furthermore place your curriculum vitae, anonymised or otherwise, in a closed section of its website(s) and client portals and/or publish it, possibly also supplemented with the test results of the tests you have taken (online).

We only process special personal data to the extent you have consented thereto or there exists a (different) legal reason for doing so. Special personal data are data concerning a person's religion or personal beliefs, race, political affinity, health, sex life, as well as data concerning membership of a trade union. This also includes criminal data and data concerning conduct that is unlawful or causes a nuisance in connection with a prohibition imposed in connection with said conduct.

The special data we process generally concern data that can be derived from your identity document, which we are obliged by law to copy when you start working for us. We may also process special personal data related to your health, whether you receive benefits or your background. We do so in order to be able to make use of (premium) discounts and/or subsidies, to comply with our reintegration obligations and to promote the government's objective of helping people with a great(er) distance to the labour market find work, which can be found in various (future) legislation and regulations. Persons with a great(er) distance to the labour market include people who have been unemployed for a prolonged period, who are aged 50 or over and/or who find it difficult or impossible to find work without reintegration support.

The special personal data you have provided to us are only accessible to persons who require these data for (the performance of) their activities and/or to comply with relevant legislation and regulations. For instance the administrators of personnel, financial, absenteeism and/or salary administration, processors, persons involved in (internal and external) quality control, (supervision of) financial reporting and the performance of premium discount and subsidy schemes. We may also forward the special personal data we have received from you to our clients if there is a legal basis for doing so. We may also forward these data to government agencies who supervise the implementation of the government objectives and/or grant (premium) discounts and/or subsidies.

Your personal data may be processed outside the Netherlands, including countries that do not have (comprehensive) privacy legislation. However, USG People has implemented extensive measures to ensure that all personal data that have been submitted are protected adequately.

USG People does not store your personal data longer than is necessary for the purposes for which they were collected and complies in this connection with the applicable legislation and regulations.

Data of employees or representatives of (potential) business relations that are processed by us

We use the personal data received by USG People from employees or representatives of (potential) business relations (such as (potential) clients, suppliers, sellers and other companies or organisations) for the following purposes:

  1. to enable you to use our services and/or to be able to use your services;
  2. to establish and maintain a trading relationship with you;
  3. to agree on assignments with you and/or perform these or have them performed;
  4. to inform you about our services and other activities (for example via e-mail, newsletters and company magazines) and to be able to make you offers;
  5. in order to be able to comply with applicable legislation and regulations;
  6. to be able to grant you access to and make use of our closed web environments, portals and intranet environments;
  7. to inform you of the products and/or services of our carefully selected partners by placing information in this regard on our websites or by including information in this connection in our newsletters, company magazines and the like.

USG People processes, inter alia, the following data: (business) name and address details (name, address, place of business), date of birth (optional, only if provided), e-mail address, data for maintaining the relationship, job and contact information. If you have been provided with a username and password to obtain access to our closed web and personal environments (self-service) portals and/or our intranet, these data are also processed by us.

USG People may forward the personal data of employees and representatives of (potential) business relations to third parties if this is in the interest of the performance of its services. Moreover, USG People may pass your data on to agency workers, candidates, applicants, employees, suppliers (for example training institutes), audit agencies, government agencies, subcontractors and to companies and/or persons it has engaged to perform certain activities (including processors). USG People may also pass your data on to third parties if it has the right or obligation to do so on the basis of legislation and/or regulations, court order or judgment, or if your consent has been obtained. USG People may furthermore place your company profile or your business' job vacancies, anonymised or otherwise, on its website and/or publish them after you have consented thereto.

We only process special personal data to the extent you have expressly consented thereto or such processing takes place in accordance with the applicable (privacy) legislation and/or regulations. The special personal data you have provided to us are only accessible to persons who require these data for (the performance of) their activities and/or to comply with relevant legislation and regulations. Security

USG People makes every effort to implement appropriate organisational and technical measures to protect your personal data against unlawful processing and/or loss. USG People employees who have access to your personal data are bound by a confidentiality clause.

It may happen, despite the security measures that we have implemented, that third parties are nevertheless able to circumvent these measures and/or use your personal data for which it is not intended. USG People can never be held liable for any damages arising out of such third party conduct  in any way.

Liability

USG People's liability for indirect losses, including consequential losses and loss of income is excluded in all cases. In addition, any liability is limited to an amount of at most €2,500 per event and subject to a maximum of €5,000 per calendar year. In any event, USG People's liability will never exceed the amount that is paid out by its insurer in case of a claim.

Right of inspection

You have the right at all times to request us to inform you of the data we are processing concerning your person. You can do this by sending an e-mail to privacy@usgpeople.nl or by sending a letter to USG People The Netherlands B.V., t.a.v. Juridische Zaken, Postbus 1, 1300 Almere. In addition, you have the right to request at any time that your data be supplemented, corrected or removed by using the procedure described above. We strive to respond to your request within four weeks after it has been received.

If you have your own closed web environment or a portal, you may also be able to (partially) supplement, correct or remove your data yourself.
